Should New York Ban Texting While Driving?

New Jersey has a new law which bans text messaging while driving.  The penalty is a $100 fine.

New York's current law that bans talking on a hand held phone while driving does not specifically prohibit sending text messages.

Should New York have a new law?  Could it be enforced?  Share your opinions:

What a joke, we can't even enforce talking on a cell phone, let alone enforce texting. Just look at the traffic, every other vehicle has someone on the phone, including law enforcement. Personally if you can't go from point A to point B without calling or texting someone, you have a problem. I thought cell phones were supposed to be a way to get ahold of someone in case of emergency if you happened to be stuck somewhere, now they are being used for senseless rabble. Ever listen to some of these conversations, I'm in the shoe aisle at Wal-mart, heading over to the dvd's, blah blah blah, get a life.

I think text messaging is dumbest thing ever created. Its a toy, not a communication tool unless you cannot talk. Why in the name would anybody even think of driving down the road and do that. It would be like using a typewritter, while driving......it does not work. No matter what you do, it takes your mind off the raod, and what copounds it worst, is the size of the buttons, reading it
As others said, its a hard to stop, but i think its required more than talking on a cell phone....todays youth use it, us baby boomers, do not

Its far more dangerous to text than talk.  The fact that there has to be a law to tell people of that fact is proof that common sense in this country has disappeared and that compulsive behavior has become the norm.  How sad.

Not another uneforceable law? Why do our legislatures WASTE money on new laws, when we can't even enforce drivers to stop at STOP signs, or turn on headlights during inclement weather, or spitting on the sidwalk. Easier to build a new bridge, than repair what is there already<:(

We don't need a new law, just amend the existing one to include "using" any cell phone or similar personal communications device without a hands-free adapter.  That should kill texting completely, since I can't figure out how to text without using ones hands.

We can not legislate what amounts to PERSONAL RESPONSIBILITY!
Want to be more responsible - SLOW DOWN - the reason the speed limit was back down at 55 originally on highways was to CONSERVE FUEL!  Now it's 65 and people do 80.

What's next? Are we going to ban eating and driving, or how about changing the radio stations while driving? Lets face it there are always going to be distractions that will take our attention away from driving. Your not going to stop it. People that drive while on the phone or eating or drinking a beverage(legal) is just as much a distraction as anything else. My feeling is that if someone is driving badly while on the phone they would probably drive just as bad while changing the radio station or doing your hair or shaving. So what do you do, just ban all things? It's my car my property and if I want to change the radio station while in it you can bet I will do it. Some of the laws that are coming out are just more reasons for the government to make money. Our freedoms are being slowly taken away from us and we are becoming a communist nation.

My daughter lives in Texas where there is no cell phone law and she calls me all the time while on the road.  My brother does the same thing in Georgia although he has a headpiece.  In our busy lives, a lot of business is taking place during those long time segments behind the wheel inbetween stops.  I admit that I talk on the phone when I'm driving long distances and the traffic is sparce but when I get in traffic, I put it down to concentrate on my driving.  I know my limits.  But on the other hand, I know there are those out there that don't and think they can actually text and drive without looking where they are going.  It's like reading a book while driving....give me a break!  Pull over or put it away.  And what's so great about texting when you could actually SPEAK to that person!

The problem is not the cell phone. It is the fact that there are people out there that can not drive without the distractions. And for this they have decided to put these stupid laws into effect. Learn how to operate your vehicle first before you decide to intentionally add distractions!!!!! People are going to do what they want regardless of the laws put in place. Don't make laws that don't apply to everyone!!

And what is it that law enforcement are allowed to talk on the phone, they are no better than we are, but get away with alot more. What did these people do in the days of no cell phones? These kids these days are definitely not experienced enough to talk or text while driving. Half of the adults are not experienced enough.

I can txt, talk, listen to music, eat, and drive, all at the same time, and all the whilw being buckled up, sober, and a safe driver. so dont try banning things. the txters are the generation who will be taking over this country. how much longer do you think those dumb bans will last? honestly.

Grotonian, your 5th grade teacher should be proud. Seems to me texting is probably what has destroyed any spelling or grammar skills you may have had. Anyway, I don't believe there should be a law against it, I just wish people had enough common sense to know how it affects their driving.

Texting is more dangerous than talking; it takes your eyes off the road. Talking can occupy the mind so attention wanders, but texting goes further. As someone pointed out, it's unenforceable anyway.
