DNA Tracking through Family Going too Far?

Posted by Christie Casciano - We've all seen crime shows and we've seen how DNA has become an important part in solving crimes.

When found at a crime scene, DNA is run through a database looking for a perfect match. Sometimes the search yields a partial match. The DNA is so similar that it could be a brother, sister, mother or father.

Technology exists to yield those near matches, but Onondaga County District Attorney Bill Fitzpatrick says the law won't allow it to be used as an investigative tool.

Fitzpatrick would like the law changed. What do you think?

what specific law are we talking about. dna can be used as a legal tool in cases. fitzpatrick should use this to re investigate some of the cases he prosecuted with a guilty verdict; [cynthia pugh case for example ] and others for this ambitious and self serving DA ; remember the motorcycle case; no proof , no evidence ; and if checked ; no dna; dna has to be used to get the evidence and prove the facts and truth[ thats what dna is all about] remember ,most cases prosecuted by fitzpatrick are circumstatial or prodded confessions ; the cases im talking about are hi profile cases , not every day shootings in the inner city.

So what is the D.A. asking for?   - to bring uninvolved individuals into a crime investigation?  to test the DNA of relatives to eliminate them from consideration?
Doesthis mean that a D.A. can demand samples from anyone he thinks might be related to a possible suspect?

What happens if someone unrelated to a crime refuses to provide a DNA sample?  Would a court allow the D.A. to go on a fishing expedition for DNA?  Are we relinquishing all of our personal privacy to make life easier for law enforcement?

Unless Mr. Fitzpatrick is prepared to accept the right of refusal, I'd say no.

When the D A has all of his family ,cousins Uncles ,aunt's DNA entered into the data base then maybe there is a case to go for family DNA. Let him set the example by requiring all of his family,no matter how far removed be tested, other wise this is just a way to go fishing for something.
